Terms of Service

These Terms of Service are general information about the rules that govern your use of Gambit Tells. They are not legal advice. Please read them before you use the service.
1. Acceptance of terms
By creating an account or using the Gambit Tells service, you agree to these Terms of Service. If you do not agree, do not use the service.
These terms form a binding agreement between you and NUYU Health Technologies Pty Ltd (ABN 35 692 027 937, ACN 692 027 937) of Level 8, 805/220 Collins St, Melbourne VIC 3000, trading as Gambit Tells.
2. Eligibility and registration
You must be at least 18 years of age to use Gambit Tells. By using the service, you confirm that you meet this requirement.
Registration is open: you create an account with your email address and a password. We may refuse, suspend, or revoke access at our reasonable discretion, including where it is necessary to protect the service or other users or to comply with the law.
3. The service
Gambit Tells provides a personal strategy coaching platform. The service helps you read relationships, understand other people, and plan your approach to significant conversations and interactions. It is a thinking and preparation tool, not a professional advisory service.
The service is currently in beta. Features may change, be removed, or be unavailable without notice. We make no guarantees about uptime or feature availability during the beta period.
4. Your account
You are responsible for maintaining the security of your account credentials. Do not share your password with anyone.
You must notify us immediately at [email protected] if you believe your account has been compromised.
You are responsible for all activity that occurs under your account.
5. Acceptable use
You agree not to use Gambit Tells to:
- Violate any applicable law or regulation.
- Harass, stalk, threaten, coerce, or harm any other person.
- Facilitate illegal discrimination based on protected characteristics.
- Generate content that facilitates violence, exploitation, or abuse.
- Attempt to reverse-engineer, scrape, or extract data from the service beyond normal use.
- Impersonate any person or organisation.
- Use the service in any way that could damage, disable, or impair our infrastructure.
You are solely responsible for how you act on the suggestions, strategies, and insights generated by the service. Gambit Tells provides perspective and analysis - the decisions and actions are yours.
6. Coaching output disclaimer
The coaching content generated by Gambit Tells is produced by automated systems and may be inaccurate, incomplete, or unsuitable for your specific situation. Generated outputs are suggestions only, not professional advice.

7. Subscriptions, billing, and cancellation
Gambit Tells offers a free tier and paid subscription plans (currently Pro and Power). You can start using the service without entering payment details. Paid plans are billed in advance on a recurring basis (monthly, or as otherwise stated at checkout), and the current price and billing period are shown to you before you subscribe. Billing is processed by Stripe on our behalf; we do not store your card details.
Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. You can cancel at any time, and cancellation takes effect at the end of the current paid period - you retain access until then. We do not provide pro-rata refunds for the unused part of a paid period except where required by law (see clause 10).
We reserve the right to change pricing. We will give you reasonable advance notice of any price increase before it takes effect on your subscription, and you may cancel if you do not accept the new price.
8. Intellectual property
Our property
The Gambit Tells service, including its software, design, brand, and knowledge base, is our intellectual property. You may not copy, distribute, or create derivative works from any part of the service without our written permission.
Your content
You retain ownership of the content you create in Gambit Tells - your target profiles, conversation notes, and coaching sessions.
By using the service, you grant us a limited licence to process and store your content solely to operate the service for you. We do not claim ownership of your content and do not use it for any purpose beyond delivering and improving the service, as described in our Privacy Policy.
9. Termination
You may close your account at any time by contacting us at [email protected].
We may suspend or terminate your account if you breach these terms, engage in abuse or harmful conduct, or where reasonably necessary to protect the service, other users, or to comply with the law. We will endeavour to give notice where we can do so safely and lawfully.
10. Australian Consumer Law and your rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). Among other things, services must be provided with due care and skill and be reasonably fit for any purpose you told us about. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that the law says cannot be excluded, restricted, or modified.
For major failures with the service, you are entitled to the remedies the Australian Consumer Law provides. If you believe a consumer guarantee has not been met, contact us at [email protected] and we will work with you to put it right.
11. Limitation of liability
Clause 10 prevails over this clause to the extent of any inconsistency: nothing here limits any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Subject to the paragraph above, and to the maximum extent permitted by law, Gambit Tells is not liable for any indirect, incidental, special, or consequential loss arising from your use of or inability to use the service, and our total liability to you for any claim arising from these terms or your use of the service is limited to the amount you paid us in the three months preceding the claim, or AU$100, whichever is greater.
You agree to indemnify us against any loss, damage, or cost arising from your breach of these terms or your misuse of the service, except to the extent the loss was caused by us.
12. Governing law and disputes
These terms are governed by the laws of the State of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth courts that sit there for any dispute arising from these terms or your use of the service. Nothing in this clause prevents you from bringing a claim in, or relying on the consumer-protection laws of, the Australian state or territory in which you ordinarily reside.
13. Changes to these terms
We may update these Terms of Service from time to time. We will notify you of material changes by updating the "Last updated" date and, where reasonable, by email. Continued use of the service after the update constitutes acceptance of the new terms.
